Personal Information Collection Statement

Introduction

Kerry Properties is committed to protecting the privacy of your personal information. This statement explains how Kerry Properties treats the personal information you submit and we collect through SuccessFactors. This statement applies to personal information provided to us, either by you or by others (such as your employer). We may use personal information provided to us for any of the purposes described in this statement or as otherwise stated at the point of collection.

For the purpose of this statement, “Kerry Properties”, “we” and “us” refer to Kerry Properties (H.K.) Limited, its holding company(ies) and affiliate(s) that has posted a position for which you are applying.  

Purposes of Collection & Use

We may collect, use and disclose the information collected in the job application form; your CV (if provided); employment references; academic transcript, qualification and training certificate (if provided); written assessments recorded in selection interviews with you (if applicable); assessment reports of any tests you undertake as part of the recruitment process (if applicable); the name, company, position, employment details and contact information of referees; the results of any vetting process (if applicable); information about your health, including any medical condition; credit record/ criminal record (if applicable); and information from your social media or professional networking profiles (if applicable) (together, the "personal information"), which may include sensitive data, for the following purposes:

  1. to assess your application for the position for which you have applied;
  2. to provide appropriate adjustments to ensure equal opportunity monitoring and reporting;
  3. to enable us to contact you about this role and/or other vacancies;
  4. to enable us to contact your former or current employer and referees to assess your application for the position for which you have applied;
  5. to process your application; and
  6. as permitted or required by law.

The above purposes are in line with our legitimate interests to decide whether to appoint you to the position as it is beneficial for us to appoint someone suitable.

Personal information marked with * on the application form are mandatory for recruitment purpose. If you do not provide such data in the application form, we may not be able to consider and process your application.

3rd Party Information

If you provide personal information about other individuals (such as employee referrals), you must show them a copy of this statement and get their valid consent prior to disclosing the data to us. If you do provide us with information about other individuals we will assume that you have obtained the relevant consent, and you hereby warrant to us that you have done so, and shall indemnify us from any claims to the fullest extent permissible by the applicable law.

Transfer & Disclosure

In order to carry out the above purposes, we may transfer or disclose your personal information to other entities within the group of Kerry Properties (including regional human resources hubs) and our agents, advisers, consultants, service providers, etc. on a need-to-know basis. Due to the nature of our operations, we may transfer your data outside the jurisdiction where you are located, but we have put in place reasonable policies and procedures to safeguard your personal information, including requiring the recipient to provide a standard of protection comparable to the protection under the laws of the place from which it is transferred. We may also have to share your personal information to respond to law enforcement requests or discovery procedures, or where required or permitted by the applicable law, court orders, government regulations, or government authorities (including tax and employment) anywhere in the world.

Retention & Security

We will retain your personal information for as long as is considered necessary for the purpose(s) for which it was collected (including as required by the applicable law or regulation). It is our policy to keep the personal information of unsuccessful applicants for a maximum period of 24 months. We may keep your personal data for longer periods where extended retention periods are required by law or regulation and in order to establish, exercise or defend our legal rights. We take all reasonable steps and maintain appropriate safeguards to help protect your personal data from accidental or unauthorized access, disclosure, loss, misuse, alteration and destruction.

Your Rights and Contact Us

Subject to the applicable law, you may have the right to access, correct/ rectify, request deletion/erasure, or restrict or withdraw your consent to processing your personal information, the right to object against profiling and the right to data portability, under certain circumstances in accordance with the applicable law. If you wish to exercise these rights, or if you have any enquiries on our data privacy policy and practice, please contact our Deputy Director, Talent Acquisition by email or in writing to the address below. Please also mark “Confidential: Personal Data Access / Correction / Enquiries” on your correspondence and be sure to include your full name, telephone number and/or address so we can ascertain your identity and specify clearly and precisely the description of your request. We may charge for a request to access your information, if permitted by the application law. In addition, you may also have the right under the applicable law lodge a complaint with your local supervisory authority (as applicable) for data protection matters. Please note that you can also delete/erase your profile by logging on to our career website however, this may not completely remove your personal information in our possession if permitted by the applicable law.

Interpretation


If there is any inconsistency or ambiguity between the English version and the Chinese version of this Statement, the English version shall prevail.
